Terms of Service
1. Agreement to Terms
By downloading, installing, or using Wakr for Windows, you agree to be bound by these Terms of Service. If you do not agree, do not use Wakr.
These Terms form a legal agreement between you and twoplus11 LLC, a Missouri limited liability company ("we," "us," or "our").
2. The Application
Wakr is a Windows system-tray application that holds your PC awake (suppressing idle sleep, display sleep, and the screen saver) for a duration you choose, using the same Windows power-management request that keeps an active download or render job from being interrupted. It is distributed from twoplus11.com/wakr/windows.
3. Beta Software
THIS IS A PRE-RELEASE ("BETA") BUILD OF WAKR FOR WINDOWS, MADE AVAILABLE FOR EVALUATION AND TESTING. IT MAY CONTAIN DEFECTS AND MAY BEHAVE UNEXPECTEDLY. DO NOT RELY ON IT AS YOUR ONLY SAFEGUARD AGAINST YOUR PC SLEEPING DURING SOMETHING IMPORTANT. KEEP YOUR OWN SAFEGUARDS (SUCH AS SAVING YOUR WORK FREQUENTLY) FOR ANYTHING TIME-SENSITIVE OR CRITICAL. WE MAY CHANGE, SUSPEND, OR WITHDRAW THE BETA AT ANY TIME.
Feedback you send us about the beta may be used to improve Wakr without restriction or obligation to you.
4. License
Personal License (Free)
We grant you a free, non-exclusive, non-transferable, revocable license to install and use Wakr on your personal computers for non-commercial purposes. Personal use means use by an individual for personal, non-revenue-generating activities. The personal tier is the complete application. There are no locked features, trial timers, or watermarks.
Commercial Use (Free)
You may also use Wakr in connection with any business, employment, commercial, or revenue-generating activity, on as many computers as you like. There is no license to buy, no seat to count, and no account to create. It is the same complete application, with no locked features, trial timers, or watermarks.
Your license is personal and non-transferable. You may not transfer, sublicense, or assign it to another person or entity.
5. Restrictions
You agree not to:
- Distribute, sell, rent, lease, or sublicense Wakr to any third party
- Reverse engineer, decompile, or disassemble Wakr except where expressly permitted by applicable law
- Remove or alter any copyright, trademark, or other proprietary notices
- Use Wakr for any illegal purpose or in violation of any applicable laws
6. Third-Party Components
Wakr is built with open-source Python libraries (including pystray for its system-tray icon and native menu, and the Pillow imaging library for rendering the tray glyph), each governed by its own permissive open-source license, the full texts of which ship inside the application. Nothing in these Terms limits your rights under those licenses.
7. Intellectual Property
Wakr, its design, original code, and all associated intellectual property rights (excluding the third-party components described above) are owned by twoplus11 LLC. These Terms do not transfer ownership of the application. All rights not expressly granted are reserved.
8. Updates and Availability
We may release updates to Wakr that add features, fix bugs, or change behavior. Updates are free for the lifetime of your license. Wakr checks for updates automatically about once a week and badges the tray menu when one exists; nothing is downloaded or installed without your consent, and you can turn the check off entirely from the menu. We reserve the right to discontinue Wakr at any time without notice, though existing installations will remain functional.
9. Payments and Refunds
Wakr is free, for personal and commercial use alike: there is nothing to buy, no license key to pay for and no subscription. A tip is the only thing this page will ever take payment for, and it is a voluntary gift rather than a purchase: it buys no feature, no license and no support commitment, and Wakr is identical whether you leave one or not. Tips are processed by Stripe; we never see or store your full card details. Because a tip buys nothing, tips are not refundable, though if you tipped by mistake write to jeremy@twoplus11.com and we'll send it back.
10. Disclaimer of Warranties
WAKR IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT WAKR WILL BE ERROR-FREE OR UNINTERRUPTED, OR THAT IT WILL PREVENT SLEEP IN EVERY CIRCUMSTANCE ON EVERY PC CONFIGURATION. YOU ARE RESPONSIBLE FOR YOUR OWN SAFEGUARDS AROUND ANYTHING TIME-SENSITIVE OR CRITICAL.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TWOPLUS11 LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, LOSS OF PROFITS, OR LOSS OF GOODWILL. OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF WAKR SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID FOR YOUR LICENSE IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) FIFTY DOLLARS ($50 USD).
12. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Missouri, United States, without regard to its conflict of law principles. Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Missouri.
13. Changes to These Terms
We may revise these Terms from time to time. We will update the "Effective date" at the top of this page. Your continued use of Wakr after any revision constitutes your acceptance of the updated Terms.
